04 Mart 2026 - OTHER Announcements

Referring to a letter received from the Nairobi Trade Attaché, it is stated that the Kenya Standards Bureau has made some important changes to the Pre-Export Conformity Assessment Guidelines (Annex-1), a copy of which is attached, published on February 19, 2026.

In this context;

- In applications for obtaining a conformity certificate, a Free Sale Certificate must be submitted to the audit firm authorized to issue the conformity certificate,

- The importer must also submit the same Free Sale Certificate to the customs administration in Kenya,

- The companies authorized to conduct Conformity Assessments in our country are determined as SGS, Intertek, TUV Rheinland & BV,

and it is requested that a decision be made on who will issue the Free Sale Certificate and under what conditions, as stated in the guidelines.

The text further states that free sale certificates are required for imports by some countries that do not have developed product safety legislation and inspection infrastructure. They legally demonstrate that the product is offered on the market in accordance with the relevant legislation, and compliance with the exporting country"s relevant legislation, not the importing country"s own product legislation, is sought. In this sense, they are the lightest of the documents that our companies encounter when entering export markets, and since they require product and legislation knowledge, they must be issued by the authorized institution responsible for the relevant product.

Additionally, it is stated that free sale certificates, which are sometimes requested from our exporters in line with the demands of importing countries, are issued by the relevant public institutions within the scope of the products within their areas of responsibility and made available to our exporters. In this context, the list of authorized institutions and the product groups they are responsible for is presented in the appendix (Appendix-2), and it is stated that our companies that will export to Kenya should apply to the authorized institutions within the scope of the relevant product groups in order to obtain free sale certificates.
