In a letter sent by the Representation of the Federal Customs Service of the Russian Federation (RSFGS) in Turkey, it was stated that problematic issues affecting the transit capacity of road border control points (BCCPs) were identified in the operational practices of the North Caucasus Regional Customs Directorate (NCC).

In this context, it was stated that the Preliminary Information (PI) is submitted to the customs administration in the form of an electronic document before and after the arrival of the goods in the customs territory of the Eurasian Economic Union (EAEU); that it is used for risk assessment and customs control, and that it can also be used as a transit declaration and/or vehicle declaration. It was reported that 30% of the goods and vehicles carried by Turkish carriers and subsequently planned to be included in the customs transit procedure arrive at the BCCP without a PI (especially for shipments using TIR carnets) or without a unique identification number used in place of the PI at the time of arrival or without an electronic transit declaration.

The article further states that the absence of the Customs Declaration Form (CD) or the failure to submit the CD to the customs administrations on time negatively affects the implementation of these systems in the Customs Clearance Systems (CCS).

On the other hand, in order to ensure the implementation of the legislation in the field of international road transport, state control is carried out within the authority of the customs administrations; • Transporting goods without the Russian Federation permit required for international road transport or with an incomplete permit;

• Presenting freight transport from/to third countries as bilateral transport

• For this purpose, carriers deliberately enter information in the third column of the CMR document, namely the place of unloading, which does not correspond to the documents accompanying the goods (invoice, declaration of goods, packing lists, etc.), in violation of the CMR Convention.

It is reported that irregularities have been detected, and that carrying out international road transport without a permit, or with incomplete or incorrectly filled permits, or with permits that do not comply with the type of transport, or without a registration slip, or without the approval of the federal executive body official responsible for control and supervision in the field of transport that the violation has been rectified, in accordance with Article 11.29 of the Russian Federation Administrative Offenses Law, gives rise to administrative liability and a fine of 100,000 to 200,000 rubles per driver is imposed.

In this regard, it is stated that the situation at border crossings has become even more complicated due to the fact that administrative investigations into detected cases take time and lead to the accumulation of a large number of vehicles in customs control areas, which negatively affects the transit capacity of border crossings, as well as increasing the dissatisfaction of carriers (vehicle drivers), and the Russian FGS requests that carriers be informed and supported regarding: • The necessity of preparing the necessary documents in advance for the passage of goods and vehicles through the EAEU customs border and submitting the data to be used as preliminary information in a timely manner before the arrival of the goods,

• The fact that carrying out transportation during international road transport without the necessary permits of the Russian Federation (including special permits, multilateral permits) or with incomplete, incorrectly filled, documents that do not comply with the type of transportation, and without a registration slip constitutes an administrative violation.
